Terms and Conditions of Sale

These General Terms and Conditions of Sale (hereinafter "GTC") govern all distance sales made by the company Babeth SPRL (hereinafter "Babeth") to its customers (hereinafter "the Customer").

Any order placed on the babeth.be website implies full and complete acceptance of these GTC. The Customer declares to have read and accepted them before validating their order.


 


 

Article 1 — Purpose

 

The purpose of these GTC is to define the conditions under which Babeth sells its products to its Customers via the babeth.be website. They apply, without restriction or reservation, to all distance sales concluded between Babeth and its Customers.

Babeth reserves the right to modify these GTC at any time. The applicable GTC are those in force on the day the order is placed.

 

Article 2 — Products

 

The products offered for sale on babeth.be are described with the greatest care. Photographs and descriptions illustrate the products but are not contractual: slight variations in color, material or finish may appear between the photograph and the item delivered, particularly due to the display settings of the Customer's screen.

Products are offered within the limits of available stock. In the event of unavailability of an item after order validation, Babeth will inform the Customer by e-mail as soon as possible and will refund the item concerned.


Article 3 — Price

 

Prices are indicated in euros, all taxes included (Belgian VAT of 21% included), excluding delivery costs.

Delivery costs are indicated separately and automatically calculated at checkout, according to the destination country, the chosen delivery method and the weight of the package. Details of delivery rates can be found on the Shipping Policy page.

Babeth reserves the right to modify its prices at any time. However, products will be invoiced based on the rates in force at the time of order validation.

In the event of an obvious error in the displayed price, Babeth reserves the right to cancel the order and refund the Customer.

 

Article 4 — Order

 

4.1 Placing the order

 

The Customer selects the desired items and adds them to their cart. After checking the contents of their cart, they validate their order by entering their contact details and delivery address, then proceed to payment.

The order is definitively registered after payment confirmation. A confirmation email, summarizing the ordered items, the total price and the delivery address, is sent to the Customer.

 

4.2 Order refusal

 

Babeth reserves the right to refuse any order for a legitimate reason, particularly in the event of a previous dispute with the Customer, non-payment of a previous order, or suspicion of fraud.

 

Article 5 — Payment

 

Payment is made online, at the time of order validation, by the following payment methods: bank cards (Visa, Mastercard), Bancontact, Apple Pay, Google Pay, Klarna, or any other method offered on the site.

Transactions are secure and the Customer's banking data never passes through Babeth's servers. They are directly processed by the payment provider.

The order is processed only after payment agreement is confirmed.

 

Article 6 — Delivery

 

Delivery terms (carriers, rates, deadlines, service areas) are described in detail on the Shipping Policy page. 

The indicated deadlines are for informational purposes only. Babeth cannot be held responsible for delivery delays attributable to the carrier or to a case of force majeure.

In the event of the Customer's absence during delivery, a delivery notice is left; the package can then be collected at the indicated relay point or post office.

 

Article 7 — Right of withdrawal and returns

 

In accordance with the Belgian Economic Law Code, the Customer has a period of 14 calendar days from receipt of their order to exercise their right of withdrawal, without having to give reasons for their decision.

Article 8 — Legal guarantee and after-sales service

 

8.1 Legal guarantee of conformity

 

Products sold by Babeth benefit from the legal guarantee of conformity provided for by articles 1649bis et seq. of the Belgian Civil Code: the Customer has a period of two years from delivery to report any lack of conformity existing at the time of delivery.

In the event of a proven defect, Babeth will, at the Customer's choice and within the limits of available stock, repair or replace the product free of charge. If repair or replacement is impossible, the Customer may obtain resolution of the sale and a refund for the product.

 

8.2 Exclusions from warranty

 

Excluded from the legal warranty are:

  • Normal wear and tear of the product;

  • Damage resulting from improper use (unsuitable washing, exposure to heat, chemicals, etc.);

  • Accidental damage or damage caused by a third party;

  • Apparent defects that the Customer could have noticed upon receipt of the product.

 

8.3 After-sales service

 

Any request related to the warranty or after-sales service must be sent to contact@babeth.be, accompanied by the order number, the Customer's full name, and if possible one or more photographs of the defect observed.

 

Article 9 — Liability

 

Babeth's liability is limited to the amount of the order concerned.

Babeth cannot be held responsible for:

  • Damage related to the use of the Internet (service interruption, intrusion, computer virus, etc.);

  • Delays or failures in performance resulting from a case of force majeure (strike, natural disaster, pandemic, administrative decision, etc.);

  • Indirect or immaterial damages (loss of opportunity, commercial prejudice, etc.).

 

Article 10 — Personal data

 

Personal data collected by Babeth for the purpose of fulfilling orders (surname, first name, address, email, phone number) is processed in accordance with the General Data Protection Regulation (GDPR) and the Belgian law of 30 July 2018.

The Customer has a right to access, rectify, erase, limit, object to and portability of their data. These rights can be exercised by simple request to contact@babeth.be.

Article 11 — Intellectual Property

 

All elements comprising the babeth.be website (texts, visuals, photographs, logos, brand, layout, source code) are protected by copyright and trademark law. These elements are the exclusive property of Babeth or its partners.

Any reproduction, representation or exploitation, in whole or in part, without the prior written authorization of Babeth, is strictly prohibited and may lead to prosecution.

 

Article 12 — Force majeure

 

Babeth shall not be held responsible for the non-execution or delay in the execution of its obligations in the event of force majeure within the meaning of Belgian case law (in particular: natural disaster, fire, flood, general strike, administrative decision, pandemic, cyberattack).

In such a situation, Babeth undertakes to inform the Customer as soon as possible and to agree with them on the terms of execution of the order.

 

Article 13 — Safeguard clause

 

If any of the clauses of these GTC were to be declared null, illegal or inapplicable by a court decision or legislative development, the validity and applicability of the other clauses would not be affected.

 

Article 14 — Applicable law and disputes

 

These GTC are governed by Belgian law.

In the event of a dispute, the Customer and Babeth will endeavor to find an amicable solution. Failing this, the Customer may have recourse free of charge to the European online dispute resolution platform (ODR): https://ec.europa.eu/consumers/odr.

Failing an amicable settlement, the French-speaking courts of the judicial district of Walloon Brabant shall have sole jurisdiction.
